Childwatch SA monitors Family Court proceedings to ensure that children's cases are handled fairly, transparently, and in accordance with the law. We document systemic failures and advocate for procedural accountability within the court system.

The Problem

South Africa's Children's Courts play a critical role in protecting vulnerable children. However, concerns about procedural fairness, inadequate investigations, insufficient consideration of safeguarding evidence and institutional accountability raise important questions about whether the system consistently fulfils its protective mandate.

ChildWatch SA examines concerns including:

• Procedural fairness: Instances in which parties report being denied a meaningful opportunity to be heard or present relevant evidence.
• Judicial independence and professional conduct: Allegations of inappropriate relationships, conflicts of interest or improper influence involving legal professionals and court officials.
• Integrity of court records: Concerns about missing, incomplete or disputed court records, recordings and transcripts.
• Safeguarding assessments: Decisions affecting children made before serious allegations have been adequately investigated or relevant evidence considered.
• Institutional accountability: Difficulties obtaining reasons for decisions, addressing procedural irregularities and securing effective oversight.

ChildWatch SA distinguishes documented procedural failures from allegations requiring investigation. Its objective is to identify systemic weaknesses, promote transparency and advocate for lawful, evidence-based decisions that prioritise children's safety and best interests.

Why It Matters

Preventable child deaths and ongoing abuse are not merely the result of excessive caseloads — they are the direct consequence of a system that places a higher priority on preservation of the family unit than on protection of the child. Accountability in the courts is essential to changing this.
