Family Court Monitoring

Childwatch SA monitors Family Court proceedings to ensure that children's cases are handled fairly, transparently, and in accordance with the law. We document systemic failures and advocate for procedural accountability within the court system.

The Problem

A major portion of our legal system's failure to protect abused children occurs in the Family Courts in South Africa. Magistrates and court personnel often lack training in issues surrounding child abuse and are more often than not indifferent to the child's allegations.

• Critical decisions are based more on personal relationships between lawyers and magistrates than on sound legal principles.
• Altered transcripts and ex parte communications undermine due process.
• Hearings are held and orders issued without court reporters.
• Traumatised children are returned to abusers by the very system designed to protect them.

What We Do

• Attend and observe Family Court proceedings where permitted.
• Document procedural irregularities and systemic patterns.
• Support families in understanding their rights within the court process.
• Report findings to oversight bodies and relevant authorities.
• Advocate for mandatory court recording and published outcome summaries.

Why It Matters

Preventable child deaths and ongoing abuse are not merely the result of excessive caseloads — they are the direct consequence of a system that places a higher priority on preservation of the family unit than on protection of the child. Accountability in the courts is essential to changing this.
